1. Our terms and conditions

Our terms and conditions (“Terms”) set out the rights you have that apply if you purchase goods from this website www.subcouture.co.uk and also all obligations applicable to you. Any other rights you have or may have under English law which, except where expressly stated in these terms, are unaffected.

These terms are important so we urge you to read them. You should contact us if there is any part of these terms that you don’t understand.

2. Who operates this site

Sub Couture Limited trading as Sub Couture (“we, us or our”), operates this website. You can contact us on 0207 229 5434 info@subcouture or sales@subcouture.co.uk. Our office is Sub Couture, 204 Kensington Park Road, London W11 1NR.

3. Using content from this website

We either own or use under licence the copyright in and the content that appears on this
website. This includes but is not limited to: images; prices; logos; and designs (including
website design). You may view and/or print single pages only from this website. If you wish
to use any of the content on our website you will require our written consent, obtained in
advance. If you do not obtain such consent your use of our images etc will be unauthorised and constitute copyright infringement.

4. Buying from this website

We always try to display items on our website that are actually held in stock, but this is not
always possible. If you order goods which we do not have in stock we will try to contact you
within 24 hours to inform you of the time delay and options available.

5. Delivery to you
For all customers who spend £70 or more on items not reduced we offer FREE next day delivery within the UK mainland.
For purchases of less than £70 or sale items our charges are:
• £3.95 for recorded delivery (2-5 working days);
• £6.95 for special delivery (next working day); or
• £12.50 for special delivery (Saturday delivery).

Orders received by us before 2.00pm on weekdays will usually be dispatched the same day

Orders received by us after 2.00pm, will be dispatched the next working day.
A postage tracking number will be emailed to you when your order has been dispatched so you can follow it and see the status of your delivery.

When your purchase is delivered a signature will be required so ensure that someone is present to receive your purchase. If there is no one in at the delivery address a card will be left informing you where you can collect your delivery from.

If there are any problems with your order that prevent us from dispatching it to you within
the timeframes above, e.g. if the item you have ordered is out of stock; we will endeavour to contact you as soon as possible to keep you updated, but in any event within 24 hours of us receiving your order.

We always aim to meet the timelines set out above but as our deliveries are carried out by a
third party it is not always possible to do so. We are therefore not able to guarantee specific
delivery times.

6. Overseas orders

We will not charge you any customs duties on your purchases if you ask us to deliver to outside the UK mainland. Any customs duties or other charges that are incurred during shipment are not our responsibility so we suggest that you check with your local post office or customs office to find out whether any duties, taxes or charges are payable on any purchases that you order from us via our website.

International customers may receive an email requesting further information when we receive their order. To confirm proof of your identity and the delivery address due to the higher security procedures as we are required to comply with for international transactions. We may require a scanned copy of the credit card used to pay for your order and a copy of a recent bank statement or a utilities bill showing the delivery address.

7. Damaged goods

We strongly recommend that you check your purchases as soon as you receive them to ensure they are not damaged or defective. In the unlikely event that your purchases are damaged or defective do not wear them and contact us as soon as possible. Please see our “returns policy” for information on how you should return your purchase to us.

8. Ownership of goods bought from us (retention of title)

All goods we supply to you remain our property until they have been paid for in full.

Where we agree to supply goods to you on credit and you fail to pay the full amount due
by the agreed payment date or if your payment is returned or recouped by your credit/
debit card provider you must return the goods to us immediately with all their original
tags and packaging. You must also compensate us in full for any damage caused to the
goods.

9. Limitation of our liability

We try hard to ensure that the information on this website is accurate and up to date, but we cannot guarantee this. Please note that we will not be liable for any losses you suffer as a result of such inaccuracies or where information is out of date.

Please also be aware that we will take all reasonable steps to ensure that your personal details are adequately protected and are Hypertext Transfer Protocol Secure (HTTPS) but we cannot fully guarantee the security of any data you provide to us when you order purchases
from our website or otherwise deal with us online.

Subject to clause 5 above, our liability to you is limited to £500.00 per event or series
of connected events in respect of: (1) for damage to physical property caused by our
negligence or (2) by the goods we have sold to you. The total of all claims arising
in connection with the goods sold to you, whether due to our breach of contract,
negligence, or otherwise, shall not exceed the price paid by you in respect of the goods
that are the subject matter of the claim in question. Our liability is not limited to you for
death or injury caused by our negligence.

Other than as set out elsewhere in these terms, we disclaim for all terms, conditions,
representations and warranties (whether express or implied) to the full extent
permissible by law.

We will/are not be required to perform any of our obligations if we are stopped/prevented from doing so by events/circumstances beyond our control or beyond the reasonable control
of our suppliers, this includes but also not limited to industrial disputes, war, flood and
changes in relevant laws or their interpretation.

10. English Governing law & jurisdiction
These terms & conditions are governed by English law and are subject to the exclusive
jurisdiction of the English courts.
